These Terms of Service ("Terms") govern your use of the Coach Management Platform website located at coachmanagementplatform.com and the Coach Management Platform CRM/App services (together, the "Service") operated by Coach Management Platform Inc. ("us", "we", or "our").
By accessing or using the Service, you signify that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms in their entirety, you may not use the Service.
1. Accounts and Registration
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Coach Management Platform provides a platform for fitness professionals to manage their clients. You, the fitness professional, are solely responsible for ensuring that your interactions with clients comply with all local health, fitness, and data protection regulations (such as HIPAA in the US or GDPR in Europe).
2. Fees and Subscriptions
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Coach Management Platform Inc. cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting Coach Management Platform Inc. customer support team.
A valid payment method, including credit card, is required to process the payment for your Subscription. If automatic billing fails to occur for any reason, Coach Management Platform will issue an electronic invoice indicating that you must proceed manually, along with a link to restore payment. Access to the software may be restricted during this period.
3. Client Data & Content
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, health data, or other material ("Content"). You are responsible for the Content that you or your clients upload to the Service, including its legality, reliability, and appropriateness.
By uploading Content to the Service, you grant us the right and license to store, parse, index, and securely display that Content exclusively for you and the applicable client. Coach Management Platform does not claim ownership over the coaching materials or templates you create on the platform.
4. Prohibited Uses
You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:
- In any way that violates any applicable national or international law or regulation.
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
- To impersonate or attempt to impersonate Coach Management Platform Inc., a Company employee, another user, or any other person or entity.
- In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful.
5. Disclaimer and Limitation of Liability
Coach Management Platform Inc. provides software tools for fitness professionals; we are not a medical or fitness provider. We make no guarantees regarding outcomes, health improvements, or financial business success as a result of using our software.
In no event shall Coach Management Platform Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
